1. SWEEPSTAKES PERIOD: The 1-800-FLOWERS.COM® Mother’s Day Collection Sweepstakes (hereinafter the “Sweepstakes”) begins at 12:00 AM Eastern Time (“ET”) on April 22, 2024 and ends at 11:59 PM ET on May 12, 2024 (the “Sweepstakes Period”).
2. ELIGIBILITY: This Sweepstakes is open only to legal residents of the 50 United States and District of Columbia, who are 18 years of age or older as of date of entry. All federal, state, and local laws and regulations apply. Employees and families of 800-FLOWERS, INC. (“Sponsor”) and its respective parent, subsidiaries, divisions, affiliates and related companies, advertising and promotion agencies, and their immediate families are ineligible.
3. TWO WAYS TO ENTER: (Maximum of one (1) Entry per Entrant regardless of method selected):
   (1) Purchase Required During the Sweepstakes Period, eligible entrants may receive one (1) entry into the Sweepstakes by: (1) visiting www.1800flowers.com/mothers-day-sweeps (the “Website”); and (2) making a purchase (“Entrant”). All online purchases (“Online Entry”) must be made by 11:59 PM ET on May 12, 2024. Alternatively, eligible Entrants may receive one (1) entry into the Sweepstakes with no purchase required via email by visiting www.1800flowers.com/win-big and completing an online entry form consisting of first name, last name, email address, telephone number and date of birth (“Email Entry”). All Email Entries must be received by 11:59 PM ET on May 12, 2024 to be included in the Grand Prize drawing. Collectively, all Online Entries and Email Entries will be referred to as (“Entries” or an “Entry”) as appropriate. Limit one (1) Entry per person/email address regardless of method of Entry. The email address associated with the person submitting the Entry will be deemed the Entrant to whom the prize will be awarded if determined the winner.
   ENTRY SUBMISSION/REQUIREMENTS: Any use of robotic, repetitive, automatic, programmed, or similar automated Entries (including but not limited to, sweepstakes or entry services) is prohibited and will result in disqualification. All Entries must be in English and must comply with these Official Rules and the registration instructions, as determined in Sponsor’s/Administrator’s sole discretion, to be eligible.
4. RANDOM DRAWING: One (1) Grand Prize winner will be selected in a random drawing on or about May 15, 2024 from among all eligible Entries received during the Sweepstakes Period. The random drawing will be conducted by the Sponsor whose decisions are final on all matters relating to this Sweepstakes. Odds of winning are dependent upon the number of eligible Entries received. Grand Prize winner will be notified by e-mail. No substitution or transfer of prize permitted, except as permitted by Sponsor in their sole discretion.
5. Winner Notification: On or about May 17, 2024, the potential Grand Prize winner will be contacted via email and will be required to execute and return, via email, a Declaration of Eligibility, and Liability/Publicity Release (where legal) within three (3) days of notification. If the potential Grand Prize winner notification is returned as non-deliverable, or if the potential Grand Prize winner fails to return the required verification documents from his/herself or respond within the required time frame, said Entrant will be disqualified. If the potential Grand Prize winner is found to be ineligible or if they do not comply with the Official Rules, said Entrant will be disqualified. If an Entrant is disqualified for one of the reasons mentioned above, an alternate potential Grand Prize winner may be selected in the same manner for the winner as described above. Acceptance of Grand Prize constitutes permission for Released Parties to use Grand Prize winner’s name and likeness for promotional purposes in any and all media.
6. GRAND PRIZE AND ACTUAL RETAIL VALUE (“ARV”): Grand Prize consisting of one (1) check made payable in the confirmed Grand Prize winner’s name for the value of eighteen hundred dollars ($1,800 USD). ARV of Grand Prize: $1,800 USD. The Grand Prize winner will be required to provide Sponsor with a valid social security number before the prize will be awarded for tax reporting purposes. An IRS Form 1099 will be issued in the name of the Grand Prize winner for the actual value of the prize. Any and all other costs and expenses associated with prize acceptance and use not specifically stated within these Official Rules as being provided are the sole responsibility of the Grand prize winner, including, without limitation, all federal, state, and local taxes.
7. GENERAL RULES: By entering, Entrant accepts and agrees to be bound by these Official Rules and winner releases Sponsor, prize provider and their respective parent, subsidiaries, affiliates, directors, officers, employees, agents and all others associated with the development and execution of the Sweepstakes from any and all liability for damages, losses or injury resulting from participation in the Sweepstakes or acceptance or use of prize. Entries will be declared to be made by the authorized email account associated with the Entry. “Authorized account holder” is defined as the natural person who is assigned to the email account associated with the submitted Entry. Entries are subject to verification of eligibility and will be declared invalid if they are incomplete, falsified, altered or tampered with in any way. Sponsor reserves the right in its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website; violates the Official Rules; or acts in an unsportsmanlike, obscene or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor and its agencies are not responsible for lost, late, incomplete, misdirected or damaged entries due to internet services providers service, weather, technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing of the Entries in this Sweepstakes. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it is not capable of completion as planned, including for infection by computer virus, bugs, tampering, unauthorized intervention or technical failures or corruption of any sort, and award prizes from eligible Entries received prior to cancellation. Void where prohibited or restricted by law.
8. GOVERNING LAW AND VENUE: THE NEW YORK COURTS (STATE & FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE SAME. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND HEREBY IRREVOCABLY SUBMITS TO THE VENUE OF THOSE COURTS WITHIN THE COUNTIES OF NASSAU AND SUFFOLK COUNTY, NEW YORK.
9. PRIVACY: Except as otherwise contemplated in these Official Rules, and to the extent entrants may otherwise elect at the time of Entry, personal information collected in connection with the Sweepstakes will be used in accordance with the online privacy notice of the Sponsor. Any communication or information transmitted to Sponsor, the Sweepstakes website by e-mail or otherwise is and will be treated as non-confidential and non-proprietary.
10. RELEASE: By entering, Entrants agree to release, indemnify, defend and hold harmless Sponsor, its suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parents, subsidiaries and affiliates, and each such party's officers, directors, employees and agents (collectively, the “Released Parties”) from and against any losses, damages, rights, claim or cause of action of any kind, in whole or in part, directly or indirectly arising out of participation in the Sweepstakes or resulting directly or indirectly from acceptance, possession, receipt, use or misuse of prize, including, without limitation, personal injury, death and/or property damage, as well as claims based on publicity rights, defamation and/or invasion of privacy.

13. LIMITATION OF LIABILITY: NEITHER 800-FLOWERS, INC., NOR ITS RESPECTIVE AGENTS, EMPLOYEES, PARENTS, SUBSIDIARIES, OR AFFILIATED COMPANIES, AS WELL AS, THEIR ADVERTISING AND PROMOTION AGENCIES SHALL HAVE ANY LIABILITY FOR ANY INDIRECT, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOSS OF OPPORTUNITY OR GOODWILL. IN ALL EVENTS, THE SOLE MAXIMUM LIABILITY OF SPONSOR AND ITS AFFILIATES SHALL BE LIMITED TO THE ARV OF THE PRIZE SET FORTH HEREIN.
